2. Acceptance of Terms
By using our website or engaging our services, you confirm that you are at least 18 years of age, that you have the legal capacity to enter into this Agreement, and that you accept these Terms and Conditions in full. If you do not accept these terms, please do not use our website or request our services.
3. Service Description
Sejahtera Legal provides family law services in Malaysia, including divorce counsel, custody and maintenance arrangements, and prenuptial and marital agreement drafting. Services are subject to a formal engagement letter and payment of fees. Information on our website is for general guidance only and does not constitute legal advice. Our services are available to individuals in Malaysia and are subject to Malaysian law.
4. Engagement of Services
A formal lawyer-client relationship is only established upon signing of our engagement letter and receipt of any required retainer. Enquiries submitted through our website or by telephone do not, by themselves, create a solicitor-client relationship. We reserve the right to decline to represent any client where a conflict of interest exists or where we are unable to act for other professional reasons.
5. User Responsibilities
You agree to provide accurate and complete information when engaging our services. You must not use our website for any unlawful purpose. You are responsible for maintaining the confidentiality of any login or account credentials. You agree not to submit information that is misleading, fraudulent, or that you do not have the right to share.
6. Intellectual Property
All content on this website — including text, design, and structure — is the property of Sejahtera Legal or its licensors. You may view and print content for personal, non-commercial use. You may not reproduce, distribute, or modify content without prior written permission from us. Documents drafted by Sejahtera Legal for clients remain the client's property upon payment of fees.
7. Fees and Payment
Starting fees are RM 180 for divorce counsel, RM 625 for custody and maintenance matters, and RM 345 for prenuptial and marital agreements. Final fees depend on the complexity and scope of each matter and are agreed in writing before work begins. Payment terms will be set out in your engagement letter. We accept payment by bank transfer and cash. Late payment may result in suspension of work on your matter.
8. Service Terms
We will handle your matter diligently and in accordance with our professional obligations. Timelines depend on court schedules, the cooperation of other parties, and factors outside our control. We will keep you informed and discuss any material changes to scope or timeline before they affect your matter. Our advice is based on Malaysian law as it stands at the time of engagement.
9. Disclaimers
Information on this website is provided for general guidance and does not constitute legal advice for your specific circumstances. We do not make any representations about the outcome of any legal matter. Legal outcomes depend on courts, counterparties, and circumstances beyond our control. Our services are provided with reasonable care and skill in accordance with our professional obligations.
10. Limitation of Liability
To the extent permitted by Malaysian law, our liability to you in connection with any single matter shall not exceed the fees paid by you for that matter. We shall not be liable for indirect, consequential, or special damages. Nothing in these terms limits our liability for fraud, negligence giving rise to personal injury, or any liability that cannot be excluded by law.
11. Termination
Either party may terminate the engagement on reasonable written notice. If you terminate, you remain liable for fees for work completed up to the date of termination. We may terminate where you fail to provide required information, fail to pay agreed fees, or where continuing the engagement would place us in breach of our professional obligations.
12. Governing Law and Disputes
These terms are governed by the laws of Malaysia. Any dispute arising from these terms or from our services shall be subject to the jurisdiction of the Malaysian courts. We encourage you to raise any concerns with us directly in the first instance. If you are dissatisfied with our response, you have the right to complain to the Malaysian Bar Council.
13. Changes to These Terms
We may update these terms from time to time. The current version will always be available on our website. Continued use of our website or services after an update constitutes acceptance of the revised terms. Material changes will be communicated via a notice on our website.
